The Commission had acted to suspend the proposed tariff for the full Missouri suspension period (roughly ten months), which sources near the utility indicated deprived them of the benefit of the filing. The tariff proposal did not propose to impact transportation customers.
Briefs were filed in the judicial action on December 12, and an argument was held on December 20. The matter is pending before the Court at this time. MGE argues that, because the PSC has imposed new costs upon it to comply with the "emergency" rule, the PSC has acted outside its authority. The PSC counters that, through the mechanism of an accounting authority order, it has assured MGE that the incremental costs of compliance will be recovered. [12/23/01]
