- Though a relative new addition
to our firm as an associate, Dave is far from inexperienced in
regulatory law.
A 1992 Juris Doctor graduate from the University of Missouri - Kansas
City, David was most recently Advisor to Missouri Public Service
Commissioner Steve Gaw. In that role he Provided legal and general
policy advice on all proceedings filed before or involving the Public
Service Commission. Many of these proceedings involved complex
regulatory, economic, engineering and accounting issues including rate
proceedings, least cost resource planning, electric RTO establishment
and operational issues, electric generation capacity additions, energy
affordability and efficiency plans, utility mergers & acquisitions
as well as the establishment of appropriate utility depreciation rates.
- Prior to that responsibility, David was Corporate Counsel for
Xspedius Communications where he represented Xspedius' regulated
subsidiaries before state utility commissions in dockets involving
declassification of unbundled network elements pursuant to the FCC's
Triennial Review Order, negotiated interconnection agreements and
amendments with SBC, Qwest and Sprint, provided general legal assistance
and counsel to various departments throughout the company and assisted
in due diligence investigations associated with several proposed
acquisitions revolving around regulatory issues including certificates,
tariffs, customer service complaints, rates, interconnection agreements
and underlying element pricing and product margins.
- From June, 1992 through February of 1998, David was Senior Counsel
for the Missouri Public Service Commission where he Represented the
Missouri Public Service Commission Staff in numerous Commission
proceedings involving regulated electric, gas, and water
utilities. David's responsibilities as Senior Counsel for the
Commission included representing the Commission in State and Federal
Court proceedings involving judicial and appellate review of Commission
decisions, extraordinary writs, injunctive relief and imposition of
penalties, and representing the Commission before the Federal Energy
Regulatory Commission in interstate natural gas pipeline rate
proceedings.
- David's practice experience
includes the Missouri Public Service Commission, the Kansas
Corporation Commission, the Illinois Commerce Commission, the
Federal Energy Regulatory Commission and the Federal Communications
Commission. He is a member of the Missouri and Kansas Bars.
- David will be based in the firm's Jefferson City, Missouri office.
